These Terms of Service ("Terms") govern your use of CareCompile's clinical intelligence platform and services. By accessing or using our services, you agree to be bound by these Terms.
1. Service Description
CareCompile provides an AI-powered clinical intelligence analysis platform that:
Aggregates clinical data from multiple sources (labs, radiology, transcriptions)
Generates unified patient profiles and summaries
Provides AI-powered clinical insights and recommendations
Flags critical values and concerning trends
Important: CareCompile is a clinical decision support tool. It does not replace professional medical judgment. All clinical decisions must be made by licensed healthcare providers.
2. Eligibility
CareCompile services are available to:
Healthcare organizations (hospitals, clinics, health systems)
Licensed healthcare providers
Healthcare IT vendors and integration partners
Organizations that agree to comply with HIPAA and applicable regulations
3. Acceptable Use
You agree to use CareCompile only for lawful healthcare purposes. You must:
Comply with HIPAA and all applicable healthcare regulations
Maintain appropriate access controls for your users
Report any suspected security incidents promptly
Use the service only for authorized clinical purposes
You must NOT:
Access data you are not authorized to view
Attempt to circumvent security controls
Use the service for non-healthcare purposes
Share login credentials with unauthorized users
Reverse engineer or attempt to extract our AI models
4. Data Ownership and Processing
You retain all rights to your data. CareCompile:
Processes data on your behalf as a Business Associate under HIPAA
Does not claim ownership of your clinical data
Will execute a Business Associate Agreement (BAA) upon request
Will not use your PHI for purposes other than providing the service
5. Service Level
We strive to maintain high availability but:
CareCompile is not a life-critical system
The service may experience planned maintenance windows
Unplanned outages may occur; we will communicate promptly
Service Level Agreements (SLA) are available for enterprise customers
6. AI Limitations
AI-generated content is provided as decision support only. CareCompile's recommendations should always be verified by qualified healthcare professionals before clinical action.
Our AI system:
May produce inaccurate or incomplete analyses
Should not be the sole basis for clinical decisions
Is continuously improving but not infallible
Requires human oversight and verification
7. Limitation of Liability
To the maximum extent permitted by law:
CareCompile provides decision support tools, not medical advice
Final clinical decisions are the responsibility of healthcare providers
We are not liable for clinical outcomes based on AI recommendations
Our liability is limited to fees paid for the service
8. Indemnification
You agree to indemnify CareCompile against claims arising from:
Your violation of these Terms
Your violation of applicable laws or regulations
Clinical decisions made using our service
Unauthorized access due to your security practices
9. Early Access Terms
During the early development phase:
Features may be added, modified, or removed
Pricing may change with notice
We may limit access to maintain service quality
Your feedback helps shape the product
10. Termination
Either party may terminate the agreement:
With 30 days written notice
Immediately for material breach
Upon termination, we will assist with data export
Data will be deleted within 90 days of termination
11. Modifications
We may modify these Terms with notice. Material changes will be communicated via email. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
